C-type Schengen Visa for the purpose of Business or Work in Hungary



C-type Schengen Visa (Employee's obligation)

A C-type Schengen visa might have to be obtained for your Employee before he enters Hungary, depending on his citizenship. Annex 1 of "Regulation (EU) 2018/1806 of the European Parliament and of the Council" lists those countries whose citizens are required to obtain C-type Schengen visa before entering the Schengen area (including Hungary) for not more than 90 days.

Annex II of this Regulation lists those countries whose citizens are exempt from C-type Schengen visa obtainment and able to enter and stay in the territory of Schengen (including Hungary) for not more than 90 days. In case of travelling regularly in and out of travel of the Schengen area, the number of days spent in the Schengen area has to be added up and the mentioned 90-day stay limit has to be understood as the sum of the days spent in the Schengen within any consecutive 180 days.

Although if an Employee's citizenship is indicated in the Annex I, obtaining C-type Schengen visa might not be needed (e.g., the Employee already has a valid C-type Schengen visa or a valid Residence Permit issued by a Schengen Country).

    Work Permit (Employer's obligation)


    In principle, an Employer intending to employ a Third-country National for 90 days or less has to obtain a work permit with respect to this Employee. However, in certain cases the Third-country National's Hungarian work is expemted from obtaining a work permit (e.g. work of Ukrainian and Serbian citizens in given professions, assignments from a company seated in another EEA country, etc.).

    We help Hungarian Employers obtain a work permit from the Government Office securing their Third-country Nationals' legal work in Hungary.

    Notifications (Employer's obligation)


    An Employer, who employs a Third-country National, has to notify the Immigration Office if the Third-country National starts working, the Third-country National does not start his/her authorised work or the work is cancelled within the period that was authorised by the Hungarian authorities. In addition, the Employer has to notify the Government Office on the start or end of the Third-country National's work if the work was not subject to a working-authorisation.
