Stricter Immigration Authority Checks Coming in 2026 – What Should Employers Prepare For?
The National Directorate-General for Aliens Policing (OIF) has published its inspection plan for 2026, outlining stricter and more targeted controls than ever before, with a primary focus on the employment of third-country nationals and the prevention of illegal work.
Who Can Expect Increased Scrutiny?
Although inspections can still be random, the OIF has clearly defined the employer groups that can expect heightened attention:
Large companies that employ a significant number of third-country workers;
Certified temporary work agencies and key employers as strategic partners;
Guest worker-focused companies where the business operation is based on low-skilled foreign labor;
Employers of those arriving with a Type C (work-authorizing) visa.
When Can Employers Expect Inspections?
According to OIF information, the authority will inspect employers operating in different sectors according to the following schedule:
Q1: bakeries and pastry units, employers employing a large number of third-country nationals, other busy public areas, transport locations;
Q2: construction investments, building sites, workers' accommodations, seasonal agricultural employers, entertainment venues, catering units;
Q3: restaurants, catering units, entertainment venues, seasonal agricultural employers;
Q4: employers employing a large number of third-country nationals, other busy public areas, transport locations, bakeries and pastry units.
What Do the Authorities Check?
During on-site and ex-post inspections, the authorities thoroughly review several aspects:
Data Consistency – The worker's actual place of work and duties must be consistent with what is stated in the permit;
Suitability of Accommodation – The living conditions and the legality of the registered accommodations are examined;
Purpose of Employment – They check whether the authorized purpose of residence and employment is genuinely realized in practice;
Authority Cooperation – Cooperation between the immigration, labor, and other inspection bodies is strengthening to curb illegal employment.
What Should Employers Pay Special Attention To?
In addition to the increased intensity of inspections, it is crucial for employers to fully comply with their reporting and cooperation obligations under the Btátv. (Act XC of 2023). This is particularly true for the employment of guest workers, where the legal requirements are extremely strict, and violations can lead to serious legal consequences.
The 2026 inspection plan conveys a clear message: lawful employment is not just an administrative matter but also a key governmental priority. Preparedness and the review of internal processes are therefore highly recommended for all affected companies.
